Access to Public Information

Any citizen or any legal person is entitled to apply for access to public information generated and stored at the Fund Manager of Financial Instruments in Bulgaria EAD (FMFIB), and also to file an application to reuse such information, according to FMFIB’s Internal Rules on Access to Public Information. The request for access to public information can be made by way of an oral enquiry or by filing a written application. The request to reuse information can only be made by filing a written application.

The business assistant at the FMFIB’s Legal Affairs, Human Resources and General Administration Unit is responsible for receiving applications for granting access to information.

Written applications for access to public information must be registered with the FMFIB EAD at the following address: 30-32, Edward I. Totleben Boulevard, Sofia 1606, on any business day between 9:00 and 17:30.

Applications received at the office fax number of the FMFIB EAD +359 2 801 4089, electronically, at office@fmfib.bg and / or using the platform for access to public information on the FMFIB’s website www.fmfib.bg  are also deemed to be written applications, and it is not necessary to use an electronic signature as defined in the Electronic Document and Electronic Signature Act.

In case the party wishes to make an enquiry orally, a statement of acceptance of an oral application for access to public information needs to be drawn up which must be signed by the applicant in person and then registered at the FMFIB EAD at the following address: 30-32, Edward I. Totleben Boulevard, Sofia 1606, on any business day between 9:00 and 17:30.

Access to information can be provided in the following forms:

- review the information, in the original or a copy, or using a public register with unrestricted access;

- oral information;

- hard copy;

- soft copy (CD, DVD);

- copies provided electronically, or an internet address where the data are stored or published;

- a combination of forms.

Access to public information is provided to the applicant or a third party against presentation of a power of attorney signed by the applicant, upon payment of the respective costs as specified in Order No. ZMF-1472 from 29 November 2011 issued by the Minister of Finance concerning standard costs of provision of public information in accordance with the Access To Public Information Act depending on the type of medium (State Gazette, No. 98 from 13 December 2011, in force as from 1 January 2012) and the presentation of a payment document.

Information from the public sector can be provided for reuse free of charge or upon payment of a fee which may not exceed the cost of reproduction and provision of such information, according to a tariff adopted by the Council of Ministers.
